1. Definitions
The following terms are used in these General Terms and Conditions (GTC):
Cosytas:
Cosytas GmbH, Farman-Strasse 14, 8152 Glattpark (Opfikon), Switzerland, UID CHE-309.336.608, operator of the online shop www.cosytas.com and contractual partner of the customer.
Customer:
Any natural or legal person who places an order via the Cosytas online shop, regardless of whether this is done for private purposes or in the course of a commercial or professional activity.
Private customer:
A customer who orders for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.
Delivery region:
The territory in which the delivery address given with the order is located: Switzerland, Liechtenstein, a member state of the European Union (EU) or the United States of America (USA). For the statutory right of withdrawal under section 10, the place of residence of the private customer is also decisive.
Order confirmation:
The electronic confirmation of receipt of an order, which is made available to the customer by e-mail and/or in the customer account.
Calendar days:
All days of the year, including weekends and public holidays.
Customer service:
The Cosytas contact point for customer enquiries, available at info@cosytas.com.
2. Scope and amendments
These GTC govern the legal relationship between Cosytas and the customer for all orders placed via the online shop. Provisions that apply only to a specific delivery region are marked accordingly. Provisions that are not marked apply to all delivery regions. The overview tables in individual sections are for guidance only; the text of the respective section is authoritative.
The GTC apply in the version published on the website at the time of the order. By completing the order, the customer confirms that they have read and accept the GTC. No order can be placed without consent to the GTC.
Cosytas may amend these GTC at any time for future orders. Orders already concluded are governed by the version valid at the time of the order.
Deviating terms of the customer apply only if Cosytas has expressly agreed to them in writing.
3. Information on the website
Cosytas endeavours to keep the information published on the website accurate and up to date. Images, product descriptions and videos are for illustrative purposes. Colours, lustre and surfaces may differ slightly from the delivered product depending on the screen, lighting and handcraft. Such minor deviations do not constitute a defect.
4. Customer account
The customer undertakes to provide truthful and complete information when registering and to update any changes in the customer account. The customer account is personal and non-transferable. Login details must be kept confidential. The customer is liable for orders placed via their account insofar as they are responsible for the misuse.
The customer may request the deletion of their customer account and their personal data via customer service. Statutory retention obligations remain reserved.
5. Order and conclusion of contract
The presentation of the products in the online shop does not constitute a binding offer but an invitation to place an order. Before submitting the order, the customer can check and correct their details in the shopping cart and at checkout. By clicking the order button with an obligation to pay, the customer submits a binding offer.
The order confirmation only confirms receipt of the order. The purchase contract is concluded with the shipping confirmation, at the latest upon delivery of the goods.
Orders are reserved for persons who are of age and have capacity of judgement. Cosytas may reject or cancel orders, in particular in the event of:
- suspected abusive or fraudulent use
- unavailability of the products ordered
- obvious pricing, typing or system errors
In the event of rejection or cancellation, the customer will be informed immediately. Payments already made will be refunded in full.
The contract language is German. Translations of the GTC are provided for information purposes. In the event of discrepancies, the German version prevails, unless mandatory law provides otherwise.

The price shown in the online shop at the time of the order is authoritative. Any applicable shipping costs are displayed at checkout before the order is submitted.
Switzerland and Liechtenstein: Prices are in Swiss francs (CHF), including statutory value added tax where shown.
EU: Prices are displayed in euros (EUR). Customs duties and import charges are not included (section 8.2).
USA: Prices are displayed in US dollars (USD). Customs duties, import charges and any applicable sales taxes (Sales Tax) are not included (section 8.2).
Payment is made using the payment methods displayed at checkout. For payment methods of third-party providers (e.g. Klarna, TWINT, PayPal), their terms and conditions also apply. The order is processed after receipt of payment or payment authorisation. Payment information is transmitted in encrypted form.
7. Vouchers, discount codes and customer programmes
Discount codes (e.g. from the newsletter) can be redeemed once per order, cannot be combined with other discount codes and cannot be exchanged for cash, unless otherwise stated for the promotion. Validity and conditions are governed by the information on the respective promotion.
Vouchers cannot be exchanged for cash. If an item paid for with a discount code or voucher is returned, only the amount actually paid will be refunded.
Any loyalty or bonus programmes are subject to the programme terms published on the website when they are introduced. Cosytas may amend or discontinue such programmes with reasonable prior notice.

8.1 Switzerland and Liechtenstein
Delivery is made from the warehouse in Switzerland by Swiss Post. No customs duties are incurred. The shipping methods, delivery times and any costs displayed during the ordering process apply. Delivery times are approximate.
8.2 EU and USA
Delivery is made from Switzerland. Shipping providers, delivery times, costs and country-specific conditions are displayed during the ordering process. Delivery times are approximate.
Shipments are handled under DAP (Delivered At Place). Cosytas is responsible for transport to the place of destination. Customs duties, import taxes and handling fees in the country of destination are not included in the price and are paid by the recipient upon delivery. Cosytas declares the goods in accordance with the applicable customs regulations.
8.3 Transfer of risk and transport damage (all delivery regions)
The risk of loss of or damage to the goods passes upon delivery to the customer or to the delivery address specified by the customer.
The status “delivered” in the shipping provider's shipment tracking serves as proof of delivery.
The customer is requested to check the shipment upon receipt and to report visible transport damage or missing items to customer service with a photo within 3 calendar days. This does not affect statutory rights.
8.4 Undeliverable shipments (all delivery regions)
If a shipment is returned to Cosytas due to incomplete or incorrect address details, refusal of acceptance or failure to collect, the customer bears the resulting costs, including the costs of re-shipment and any customs duties. If no response is received within 4 weeks of the return, the order is deemed cancelled. Payments already made will be refunded less these costs.
9. Voluntary right of return

9.1 Scope
Cosytas grants a voluntary right of return of 14 calendar days from delivery in all delivery regions.
EU and Liechtenstein: Private customers resident in the EU or in Liechtenstein additionally have the statutory right of withdrawal under section 10. Insofar as the statutory right of withdrawal is more favourable to them, it takes precedence over this section 9.
9.2 Conditions
- The return is registered in advance via the returns portal or by e-mail.
- The items are unworn, undamaged and complete in their original packaging.
- The return is sent with tracking and from the country to which the goods were delivered.
Excluded from the voluntary right of return are personalised or custom-made items and reduced-price items.
9.3 Return costs
The customer arranges the return themselves and bears its costs, except in the case of an incorrect delivery (e.g. wrong or damaged item). Cosytas is not liable for the loss of uninsured returns in transit. The tracking number must be kept until the refund has been made.
EU and USA: The return crosses a customs border into Switzerland. In addition to postage, the customer bears the customs duties, import taxes and customs clearance and handling fees incurred on the return. The shipment must be declared as a return (returned goods) and accompanied by a copy of the invoice. Costs that Cosytas has to pay on the import of the return are deducted from the refund amount. Customs duties and import taxes paid by the customer on delivery of the goods are not payments to Cosytas and are not refunded by Cosytas.
9.4 Refund
The refund is generally made within 7 days of receipt and inspection of the goods, using the payment method originally used. Items that do not meet the conditions will be sent back at the customer's request and expense.
10. Statutory right of withdrawal (EU and Liechtenstein only)
Private customers resident in a member state of the European Union or in Liechtenstein have a statutory right of withdrawal. The following instructions on withdrawal apply in this respect. For private customers resident in Switzerland or the USA, only the voluntary right of return under section 9 applies.

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. In the case of a contract relating to multiple goods ordered in one order and delivered separately, the withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, you must inform us (Cosytas GmbH, Farman-Strasse 14, 8152 Glattpark (Opfikon), Switzerland, e-mail: info@cosytas.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the model withdrawal form available at www.cosytas.com/en/pages/withdrawal-form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to Cosytas GmbH, Farman-Strasse 14, 8152 Glattpark (Opfikon), Switzerland, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion or early expiry of the right of withdrawal
The right of withdrawal does not apply to contracts for the supply of goods made to the consumer's specifications or clearly personalised (e.g. engravings). The right of withdrawal expires early in the case of contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if they were unsealed after delivery.

Additional information on returns from the EU
- Returns from an EU member state to Switzerland cross a customs border. In addition to postage, the direct costs of the return borne by the customer include the customs duties, import taxes and the shipping provider's customs clearance and handling fees incurred on the return.
- The shipment must be declared as a return (returned goods) and accompanied by a copy of the invoice so that it can be imported into Switzerland without charges where possible. If costs arise because this information is missing, they are borne by the customer.
- Customs duties and import taxes that the customer paid to the customs authority or to the shipping provider on delivery of the goods are not payments to Cosytas and are not refunded by Cosytas. Any reclaim must be made to the competent customs authority or to the shipping provider.
- Returns from Liechtenstein do not cross a customs border.
11. Warranty (all delivery regions)
The statutory provisions on warranty apply to defects in the products delivered, unless otherwise provided in this section. Cosytas does not provide any further guarantee.
Defects must be reported to customer service immediately after their discovery, with photos enclosed. In the case of a justified defect, Cosytas may, at its discretion, repair or replace the product or refund the purchase price in full or in part.
EU and Liechtenstein: Mandatory statutory warranty rights of the private customer's country of residence remain reserved.
The following in particular do not constitute defects:
- normal signs of use such as scratches or loss of lustre
- natural wear from wearing, in particular of gilding, plating or vermeil
- natural tarnishing (oxidation) of silver
- wear of leather and textile cords
- damage caused by improper handling, storage or care
- damage caused by contact with water, chemicals, cosmetics or perfume
- interventions or repairs by third parties
- damage occurring after delivery
Information on materials and care can be found on the product pages. Persons with known metal allergies are advised to check the material information before purchase.
12. Liability (all delivery regions)
Cosytas is liable for damage it has caused intentionally or through gross negligence. Liability for slight negligence, for indirect damage, consequential damage and loss of profit is excluded to the extent permitted by law. Likewise, Cosytas is not liable for damage resulting from force majeure, official measures or disruptions at third-party providers.
Mandatory statutory liability, in particular for personal injury, remains reserved.
13. Retention of title
The products delivered remain the property of Cosytas until paid for in full.
14. Data protection
Personal data are processed in accordance with the privacy policy published on the website.
15. Intellectual property
All content on the website, in particular texts, images, videos, logos and designs, is protected and belongs to Cosytas or to the named rights holders. Any use without prior written consent is prohibited.

The contractual relationship is governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-law rules.
Switzerland: Private customers may bring an action at their place of residence or at the registered office of Cosytas GmbH. Actions by Cosytas against private customers must be brought at their place of residence.
EU and Liechtenstein: Mandatory consumer protection provisions of the state in which the private customer has their habitual residence remain reserved. Jurisdiction is governed by the mandatory statutory and treaty provisions, in particular the Lugano Convention.
USA: The place of jurisdiction is the registered office of Cosytas GmbH, unless mandatory law provides otherwise.
Orders for commercial or professional purposes (all delivery regions): The exclusive place of jurisdiction is the registered office of Cosytas GmbH.
17. Final provisions
Should any provision of these GTC be wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the statutory provision.
