1. Definitions
In the following Terms and Conditions, the following terms shall have the meanings set forth below:
Cosytas GmbH (hereinafter referred to as "Cosytas"): The contractual partner of the customer.
Special Conditions:
Product- or category-specific provisions listed separately on the website.
Order Confirmation:
The electronic confirmation of receipt and acceptance of an order provided to the customer by email and/or via their user account.
Customer:
Any natural or legal person who places an order through the Cosytas website, regardless of whether as a consumer (private individual) or within the scope of a commercial or professional activity (business).
Calendar Days:
All days of the year, including weekends and public holidays at Cosytas’ registered office.
Working Days:
All calendar days excluding Saturdays, Sundays, and public holidays at Cosytas’ registered office.
Customer Service:
The designated contact point at Cosytas for customer inquiries.
2. Scope and Amendment of the Terms
These Terms and Conditions govern the legal relationship between Cosytas and the customer and form an integral part of the purchase contract concluded between the parties. By completing an order through the website, the customer expressly declares that they have read, understood, and accepted these Terms. Without acceptance of the Terms, an order is not possible.
Cosytas reserves the right to modify these Terms at any time and without stating reasons. The version published on the website at the time of the order shall apply.
3. Website Information
Cosytas endeavors to keep the information published on the website accurate and up to date. Images, product descriptions, and videos are for illustrative purposes only and are non-binding. Deviations from the delivered product are possible.
4. Registration and Customer Account
The customer undertakes to provide truthful and complete information when registering. Changes to customer data must be updated immediately in the user account. The customer account is personal and non-transferable. The customer is liable for all orders placed via their account.
5. Order and Conclusion of Contract
Orders may only be placed by persons of legal age and with full legal capacity. The purchase contract is concluded upon dispatch of the shipping confirmation or at the latest upon delivery of the goods.
Cosytas reserves the right to reject or cancel orders, in particular in the following cases:

Suspicion of abusive or fraudulent use

Unavailability of ordered products

Technical errors in the pricing or inventory system
6. Delivery and Shipping
6.1 Domestic Shipping (Switzerland and Liechtenstein)
Delivery is made from Cosytas’ Swiss warehouse via Swiss Post. The shipping methods, delivery times, and any applicable costs displayed during the ordering process are binding.
Delivery is deemed completed once the shipment is marked as "delivered" in Swiss Post’s tracking system.
Cosytas is not liable for loss or damage after the shipment has been handed over to the carrier.
In the event of a return due to incorrect or incomplete address details, refusal of acceptance, or failure to collect, all resulting costs shall be borne by the customer.
6.2 International Shipping
Cosytas offers shipping to selected countries. The available shipping providers, delivery times, costs, and country-specific conditions are transparently displayed to the customer during checkout. Shipping is generally from Switzerland.
International shipments are processed under the DAP (Delivered At Place) method. This means customs duties, import taxes, and handling fees are not included in the checkout price and must be paid by the customer, if applicable. Additional charges may therefore arise upon or after delivery.
Cosytas undertakes to declare the goods in accordance with applicable customs regulations. Cosytas assumes no liability for delays or returns due to customs clearance issues or delivery obstacles in the destination country.
In the case of a return due to incorrect or incomplete address details, refusal of acceptance, or failure to collect, the customer shall bear all resulting costs, including repeated customs duties, taxes, or handling fees.
7. Right of Return
The customer may return unworn and undamaged products within 14 calendar days of delivery.
Returns must be made in the original packaging and in original condition. Return shipping costs and any applicable customs or import fees are borne by the customer, unless the return is due to a defect attributable to Cosytas.
For hygiene reasons, earrings are excluded from the right of return, unless a proven defect is present.
Returns that are not in a resaleable condition may be rejected or refunded at a reduced rate.
Refunds are made using the original payment method and may take up to 14 working days.
8. Prices
All prices are stated in Swiss Francs (CHF) and include – unless otherwise specified – shipping and handling costs for deliveries within Switzerland and Liechtenstein. For international orders, prices may be displayed in the local currency, depending on technical availability; conversion is based on current exchange rates.
The price at the time of the order is decisive.
9. Payment Terms
Payments can only be made via the payment methods shown at checkout. Orders are processed only after full payment. Refunds are generally issued via the original payment method. Payment information is transmitted in encrypted form.
10. Warranty
Cosytas warrants that the products are free from material and manufacturing defects at the time of transfer of risk. Obvious defects must be reported in writing within 3 calendar days of delivery, including photo documentation. Later complaints cannot be considered.
The warranty does not cover:

Signs of use or age-related wear

Damage due to improper handling or storage

Contact with water, chemicals, or perfume

Interventions or repairs by third parties

Transport damage after successful delivery
In the event of a justified defect claim, a replacement delivery or refund will be made.
11. Retention of Title
Until full payment has been received, the delivered products remain the property of Cosytas.
12. Limitation of Liability
Cosytas is only liable for damages caused by gross negligence or willful misconduct. Further liability – especially for indirect damages, consequential damages, loss of profit, or data loss – is excluded to the extent permitted by law. Cosytas is not liable for damages due to force majeure, official measures, or third-party service interruptions.
13. Data Protection
The collection and processing of personal data is carried out in accordance with the privacy policy published on the website.
14. Governing Law and Jurisdiction
The contractual relationship is governed exclusively by Swiss law, excluding the UN Sales Convention and conflict-of-law rules. The exclusive place of jurisdiction is the registered office of Cosytas GmbH.
